Description

The course aims to provide a sound academic grounding in key principles of the law of evidence. It will examine the key topics of relevance, reliability, probative value, illegitimate prejudice, the influence of human rights, burden of proof, rules of inadmissibility (including hearsay, veracity and propensity and privilege), and trial procedure. In focusing on these key aspects of the law of evidence this course will adopt a strong principle based approach in which the theoretical underpinnings of the development of the law will be examined and discussed.

Learning Outcomes

The objectives of CRJU308 Principles of Evidence are to enable you to:

1. Explain key principles governing the admissibility of evidence in New Zealand courts.
2. Apply evidential rules to courtroom scenarios by determining whether evidence is likely to be admitted or excluded and explaining the reasons for that outcome.
3. Assess the reliability, fairness, and potential impact of different forms of evidence.
4. Demonstrate understanding of how evidential rules structure courtroom processes, including the treatment of witnesses, evaluation of testimony, and protection of fair trial rights.

Prerequisites

(1) CRJU202 and 45 additional points at 200-level from Schedule C of the BCJ, or
(2) LAWS202 and 30 additional points at 200-level from Schedule C of the BCJ.
