Description

Theory and Practice of client interviewing, negotiation and mediation, lawyers' roles and professional responsibility.

The purpose of the course is to provide students with a “starter course” in client interviewing, negotiation and mediation.
The focus of the course will be to provide students with knowledge and some of the practical skills that they will need when they commence practising law in the areas of civil/commercial negotiation and mediation.

The course will not be recorded.

The course depends on all students being present to undertake collaborative/interactive work in pair, trios etc.

The objectives of the course will include:
• Familiarising the students with the theory of client interviewing, negotiation and mediation;
• Teaching the students some practical skills in client interviewing, negotiation and mediation;
• The practical skills component of the course will include questioning techniques, advocacy skills and preparing documents such as file notes recording client interviews and litigation risk assessments. The students will also learn the relevant rules of professional responsibility;
• The practical skills will be delivered through the students in pairs and small groups, working on practising client interviews, problem scenarios, participating in a negotiation role play and preparing a written litigation risk assessment for a mediation;
• The assessments for the course will reflect the significant emphasis on knowledge and skills;
• There will be assessments for each part of the course content (client interviewing, negotiation and mediation);
• The course will be intensive and students are expected to do extra reading and work to prepare for the lectures and assessments outside of the teaching hours of 10am-5pm.

Prerequisites

Must have passed either LAWS301 or a minimum 15 points of 300 level courses listed in Schedule E to the regulations for the Degree of Bachelor of Laws.
