Law of Agency
Intermediaries are widely used for the making of contracts, and this course deals with the law which relates to such contracts. The general principles of agency permeate many areas of the law which are taught in other courses, such as Contract, Company Law and Partnership, Equity, Tort and Commercial Law subjects generally. The law relating to principals, agents and third parties is examined generally and some particular classes of agents, such as partners, real estate agents and insurance intermediaries, will be dealt with in detail.
The course aims to give students a broad understanding and recognition of the essential elements of agency law; and to give an appreciation of the place of agency principles in the many legal contexts in which they have practical application. Since this is a half course (ie about 12 two hour lectures) the focus will be on the essential and basic features of the subject. It is important that a good grasp of principle be obtained.
