The course examines selected problems in international investment law and arbitration relevant to a New Zealand context.
This course complements LAWS338 (World Trade Law). In LAWS338, we deal with the international trade rules as set out in the WTO Agreement. These rules apply almost universally. In this course, we will cover international investment agreements, which are bilateral, such as Chapter 11 of the New Zealand-China Free Trade Agreement, or regional, such as Chapter 9 of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership. We will address the substantive rules, ie the interpretation and application of investment treaties, expropriation, standards of protection, as well as the procedural rules, ie the settlement of disputes (state vs state and investor vs state).LAWS371 and LAWS338 together belong to the broader area of international economic law.
