The course will give students an understanding of the legislation and regulations that regulate financial markets in New Zealand.

This course is an elective subject of the LLB. The course will consider the regulation of financial service providers (e.g. issuers of securities and financial advisers) and financial products (e.g. debentures, shares, Kiwisaver and superannuation schemes, and derivatives). The course will consider financial markets law within an integrated financial system that includes the environment, communities and a bicultural Aotearoa/NZ.

Learning Outcomes

  • On successful completion of this course, students should be able to:
  • Understand the regulatory framework for financial service providers and financial products;
  • Identify and apply the Financial Markets Conduct Act 2013 and other relevant legislation and policy in the financial markets context;
  • Understand the role of the Financial Markets Authority and other relevant regulatory bodies;
  • Understand how financial markets law in an integrated financial system that includes the environment, communities and bicultural Aotearoa/NZ;
  • Identify and critically analyse legal issues in relevant factual situations; and
  • Further develop skills such as legal analysis and critical reasoning.
