A course to familiarise students with the different facets of international dispute resolution and some substantive matters that are the subject of international dispute resolution, including international commercial litigation, international arbitration and international mediation, and public international dispute resolution.
International disputes range from business-to-business disputes about a sale gone wrong, to (maritime) boundary disputes between two countries, to a Peruvian farmer who sues one of Germany’s largest energy companies for its carbon footprint. This course familiarises the students with the different mechanisms to resolve an international dispute and some of the substantive laws that form the basis of international disputes, such as the UN Convention on Contracts for the International Sale of Goods, the International Covenant of Civil and Political Rights, or the United Nations Convention on the Law of the Seas. Students will have the opportunity to get an overview of subjects such as private international law, international civil procedure, international arbitration, international human rights, law of the sea, international trade. The Zoom sessions will be recorded. However, the attendance for the guest Zoom lecture sessions will be mandatory. All effort will be made that those guest lectures are advertised early and are all at the same time and day of the week. However, given that the guest lecturers will be the leaders in their field and busy practitioners short notice changes might occur. The course is a distance course. It requires students to be able to manage their own workload. The course requires students to engage with the online material themselves. The material is presented in modules which contain videos, readings and a quiz that tests the students on their understanding of the module. There also will be guest lectures by highly acclaimed international dispute resolution specialists. Some of the assessment will involve group work.
