The general principles governing the formation of contracts, vitiating elements, breach of contract and remedies.Contract is a very large subject and it is impossible in one year to teach all aspects of it. This course, therefore, is confined to general principles. In later subjects in the degree various aspects are dealt with in more specific detail: for example, Laws 331 Sales and Consumer Law, Laws 341 Insurance Law and Laws 346 Law of Agency.Contract Law is a mix of common law and statute; most of the statutes studied are fundamental and are unique to New Zealand. The course therefore provides a valuable opportunity to compare the contrasting approaches of common law and statute. The course covers the topics of offer and acceptance, finality and completeness, intention to create legal relations, consideration, terms of the contract, exclusion clauses, vitiating elements, misrepresentation and cancellation, and remedies.
