The course aims to provide a sound academic grounding in the Property (Relationships) Act 1976, Child Support Act 1991, and the adult maintenance provisions of the Family Proceedings Act 1980.
Relationship Property and Family Finance Law is an important area of property law that is practised by both general legal practitioners and specialist family lawyers alike. This course examines the law and policy of the Property (Relationships) Act 1976, which is the statute dealing with the division of the property of married and de facto couples upon their separation. Particular attention will be paid to current topical issues such as the New Zealand Courts' treatment of family trusts. The law and policy governing awards for adult maintenance under the Family Proceedings Act 1980, and the child maintenance under the Child Support Act 1991, are also examined. The course includes tutorials and guest lectures, and an optional moot.
