Special Topic: Global Value Chains: Access to Justice

Global Value Chains (GVCs), accounting for 70% of international trade, encompass the full range of activities required to bring a product or a service from conception to end-use. GVCs are predominantly driven by big Multinational Corporations (MNCs) that spread their activities across the world through multiple subsidiaries – think mining, oil, tech, fashion – to source essential components (oil, rare minerals, etc) or to save on manufacturing costs (cheap labour, poorly regulated labour markets, etc). When victims suffer harm as a result of the activities of MNCs and their subsidiaries, access to justice is severely compromised by the transnational dimension and prohibitive costs of litigation, the inequality of litigating parties, and the lack of effective regulation at national and global level. This course explores access to justice by way of private international law and human rights initiatives, as those have played out in recent transnational cases.

Class discussion and participation are mandatory. Considering the multi-faceted and global nature of the course, student views and ideas are critical contributory factors to the understanding and overall successful completion of the course.

All case law will be discussed and analysed in detail in class. There will be significant group work: prescribed readings will be shared amongst groups to report back and discuss in class. As this is a dynamic, developing area of law, students will be expected to follow latest developments through recommended websites and report back to class. This will feed into the final written assignment.
